Mr. Bimal Kumar Jha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 18-04-2018 Heard learned counsel for the petitioners, the learned APP for the State as well as the learned counsel appearing on behalf of the informant.
Petitioners, already in custody, seek bail in connection with Benipatti PS Case No.253 of 2017 registered under Sections 341, 324, 307 and 120(B) of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that the son of the informant was shot by some person and it is alleged that due to the land dispute with Kaushalya Devi and Vishwanath Prasad the present occurrence has been committed and all accused persons conspired and thereafter committed the occurrence.

No.12259 of 2018(3) dt.18-04-2018 2/2 Learned counsel for the petitioners submits that there is no eye witness of this case, the statement of the injured recorded by the police clearly indicates that he had not seen anybody firing at him, moreover the petitioners are not conerned with the dispute in between the informant and other co-accused Kaushalya Devi and others and later on a new story is developed that Rs.5,00,000/- was taken by Munna Singh from the victim and did not want to return back the money and the petitioners are father and younger brother of Munna Singh. Having considered the aforesaid facts and circumstances, petitioners, namely, Baban Singh @ Vavan Singh and Jhunna @ Jhunna Singh @ Shashank are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Benipatti, District Madhubani in connection with Benipatti PS Case No.253 of 2017, corresponding to G.R. No.999 of 2017.
