2. The petitioner is in custody in connection with Parsauni P.S Case No. 136 of 2014 registered for the offences punishable under Sections 395 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner along with other 30 to 40 accused persons had committed dacoity in the informant's house and took the mobile phones, gold ornaments and other articles.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR rather his name has been figured on the basis of the confessional statement of
Patna High Court CR. MISC. No.47667 of 2025(2) dt.08-08-2025 2/2 the co-accused. Moreover, nothing has been recovered from the possession of the petitioner nor TIP has been conducted by the police official It is also submitted that petitioner is in judicial custody since 15.11.2022 having five criminal antecedent as mentioned on paragraph no. 3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order dated 23.10.2024, it appears that nothing has been recovered from the possession of the petitioner nor TIP has been conducted. Moreover, petitioner name has been figured from the confessional statement of the co-accused. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional District Judge-VIII, Sitamarhi in connection with Parsauni P.S Case No. 136 of 2014.
