Mr. Sri Dilip Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 16-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Khagaria Muffasil P.S.Case No. 782 of 2017 registered under Sections 25(1-b)a,26,27 and 35 of the Arms Act.

Allegation in brief is that police raided at the place of occurrence getting information that firing is going on between Ram Lagan Yadav and Ranveer Yadav and petitioners were apprehended with country made musket and one spent cartridge. Submission is that petitioners are Battaidar of Chandradeo Prasad and one local criminal Ranveer Yadav was trying to forcibly dispossessed from the land and for that landlord filed a case four months prior to the present case and

Patna High Court Cr.Misc. No.11988 of 2018(3) dt.16-04-2018 2/2 due to that reason, petitioners have been implicated falsely and they are in custody since 07.11.2017.

Having considered the aforesaid facts and circumstances, the petitioners, namely , Ram Lagan Yadav, Adalat Yadav and Murari Yadav, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Khagaria Muffasil P.S. Case No. 782 of 2017 with condition that one of the bailor must be their close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, their bail bonds shall be liable to be cancelled.
