Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 18.12.2015 in a case registered under section 302 and other minor sections of the Indian Penal Code as well as 3(2)(v) of the Scheduled Castes and Scheduled Tribes ( Prevention of Atrocities )Act. It is the case of the prosecution that four persons started assaulting the deceased and injured him and, after that, six more persons including petitioner came there and participated in the aforesaid assault. There is no specific overt act attributed against the petitioner. Moreover, post mortem report of the deceased

Patna High Court Cr.Misc. No.20108 of 2016 (2) dt.09-05-2016 2/2 reveals that only one injury was found on the person of the deceased. The investigation against the petitioner appears to have already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Hisua P.S. Case No. 291 of 2015 (G.R. No.3503 of 2015).
