JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Allegedly, one country made loaded pistol along with one live cartridge was recovered from possession of the petitioner when he along with two others had assembled to make preparation for committing loot. The application of Section 399 read with Section 402 of the Indian Penal Code appears to be doubtful. So far as Sections 25(1-b) A, 26, 35 of the Arms Act is concerned, petitioner is in jail custody since 26.12.2014. Moreover, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
