Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code and Section 25(1-b)a, 27 of the Arms Act.
The FIR of the occurrence of dacoity is against unknown. Name of the petitioner had surfaced in the confessional statement of co-accused, namely, Sagar Mandal. The petitioner is in custody since 29.04.2017, however, he has not been put on TI Parade during investigation nor anything has been recovered from his possession. The investigation of the case is already complete now against the petitioner.
Considering the facts and circumstances, let the
Patna High Court Cr.Misc. No.17860 of 2018 (2) dt.02-04-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 711 of 2017 arising out of Kotwali (Tilkamanjhi) Police Station Case No. 588 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
