The petitioner seeks bail in a case registered for the offences punishable under sections 406, 420, 409 of the Indian Penal Code.

The B.S.F.C. has alleged that the petitioner lifted 31, 227.40 quintals of paddy whereas the petitioner stated that he lifted only 4800 quintals of paddy and he has already returned the entire amount of rice to the B.S.F.C. after milling the same. It is submitted that a certificate case is going on. The Collector made an inquiry. The petitioner has also mortgaged his immovable property of more than the amount allegedly lying due against the petitioner. The petitioner is in jail since

Considering the fact that the petitioner disputed the amount of paddy allegedly lifted by him and the petitioner had already deposited the rice after milling the paddy which he had lifted and has also mortgaged the immovable property, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhabua in connection with Chainpur P.S. Case no. 67 of 2015.
