JUSTICE SANDEEP KUMAR ORAL ORDER 19-04-2023 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Pursuant to the order dated 12.04.2023 the petitioner has handed over two demand draft totalingof Rs. 35 lakhs to the opposite party no. 2.

Both the parties have also agreed for filing the divorce on mutual consent and the applications have been filed by both the parties.

The application for divorce by mutual consent is going to be filed at Gaya..

The Principal Judge, Family Court, Gaya is directed to conclude the divorce proceedings at the earliest after condoning the period of six month between the first motion and the second motion and after payment of the balance amount of

Patna High Court CR. MISC. No.51165 of 2022(12) dt.19-04-2023 2/2 Rs. 10 lakhs, the final order in the divorce proceeding will be passed by the Principal Judge, Family Court, Gaya. The present application has been filed for quashing the order dated 27.05.2022 passed by the S.D.J.M. Gaya passed In Gaya Muffasil Case No. 244 of 2016 by which the discharge application has been rejected.

In view of the settlement between the parties, the entire prosecution of Gaya Muffasil P.S. Case 244 of 2016 including the order dated 27.05.2022 is hereby quashed against all the accused persons.
