JUSTICE AMARESH KUMAR LAL ORAL ORDER 05-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Section 379 of IPC.

Allegation is that the informant taking Rs.3,42,000/- went to Muzaffarpur from Motihari with his brother Rahul Singh to purchase a motorcycle. In the way, at Bairiya round about the petitioner met with them and all the three went to Yamaha Motor Cycle Showroom but it was closed. Thereafter, the petitioner offered him to stay at his residence. All the three after taking meal slept in the room. In the night at about 2 a.m., the brother of the informant, Rahul Singh awoke and found that the bag containing

Patna High Court Cr.Misc. No.27739 of 2015 (2) dt.05-08-2015 2/3 money was missing. It has been suspected that the petitioner has committed theft of Rs.3,42,000/- .

It is submitted that the petitioner has been falsely implicated in this case. It is absurd that one can go to purchase a motorcycle with Rs.3,42,000/-. The informant is a student and Rahul Singh is also aged about 17 years. The informant has made concocted story against the petitioner.

It is further submitted that the petitioner is a student of B.A. aged about 21 years and he is the co-villagers of Rahul Singh. He has no criminal antecedent. However, after investigation charge-sheet has already been submitted and there is no chance of tampering with the witnesses.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/court concerned in Ahiyapur P. S. Case No. 371 of 2015 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
