JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Majorganj P.S. Case No. 303 of 2015, registered under Sections 363, 365, 370, 120(B) and 370(A) of the Indian Penal Code and Section 5/6 of I.T.P.A. Act.

The accusation is that on 22.12.2015, five month's daughter of the informant was taken by Sajmun Khatoon and Kalahi for playing the child, but they did not return her child. One day earlier Sajmun Khatoon asked the informant to sell the child on payment of Rs. 20,000/-. The informant raised suspicion that the petitioners, who used to come at the house of the Sajmun

Patna High Court Cr.Misc. No.18680 of 2016 (3) dt.29-06-2016 2/2 Khatoon has took away her child.

Learned counsel for the petitioners submits that petitioners have been implicated in this case mere on suspicion. Moreover, after four hours of the occurrence and lodging the F.I.R. the daughter of the informant recovered at the road, where Sajmun Khatoon was present. Except the suspicion, there is nothing against the petitioner to show the hand of the petitioners in kidnapping of the child of the informant. The petitioners having no criminal antecedent is in custody since 23.12.2015. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S.
