JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was apprehended by the police on the accusation that he used to issue forged documents to the truck drivers so that the truck drivers could cross the check post. It is alleged that in huge quantity, government forms and other articles were recovered.

The contention on behalf of the petitioner is that one Ram Bali Kumar Yadav @ Ram Bali Yadav was owner of the room from where the alleged recovery was made and so far as petitioner is concerned, he was only an employee of aforesaid Ram Bali Kumar Yadav. It is further contended by him that even if it assumed that in huge quantity government forms and other

No.28125 of 2015 (2) dt.07-08-2015 2/2 articles were recovered from the room of Ram Bali Kumar Yadav, then also, there is nothing on the seizure list to show that any incriminating article was recovered from the aforesaid room. Moreover, co-accused, Ram Bali Kumar Yadav @ Ram Bali Yadav has already been admitted to anticipatory bail by a coordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.P. Singh, Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Barachatti P.S. Case No. 183 of 2015. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
