Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 IPC. Petitioner is husband of the victim of dowry death. He is in custody since 18.05.2018.

In the past prayer for bail to the petitioner was refused on 20.11.2019, vide order at Annexure-1, considering the fact that charges were framed on 01.03.2019 and prosecution evidence was going on.

Submission is that the trial is still pending and in pursuance of order dated 20.11.2019, at Annexure-1, the petitioner was granted liberty to renew his prayer for bail before the learned court below in the event of non-conclusion of the trial. However, the learned court below has not granted bail to the petitioner by the impugned order dated 02.09.2020.

No.6987 of 2021(2) dt.19-02-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr.No.26 of 2019 arising out of Dalsinghsarai Police Station Case No.94 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
