Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Ashok Kumar No.6, Advocate For the Opposite Party/s : Mr. Suresh Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection Sessions Trial No. 258 of 2014/110 of 2014 arising out of Aurangabad Town P.S. Case No.94 of 2014 in which charges have been framed for the offences punishable under sections 395 and 412 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 24.9.2014 passed in Cr. Misc. No.34623 of 2014. It has been contended that though charges have been framed on 2.8.2014, no witness has been examined on behalf of the prosecution so far.

Be that as it may, for the reasons assigned in the

Patna High Court Cr.Misc. No.29609 of 2015 (2) dt.10-07-2015 2/2 aforesaid order dated 24.9.2014, I am not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected.

Since the petitioner is in custody for the last fifteen months, the court below is directed to conclude the trial as early as possible preferably within seven months from today failing which the petitioner would be at liberty to renew his prayer for bail.
