The petitioners seek bail in connection with Bihariganj P.S. Case no. 238 of 2017 registered under Section 30(a) of Bihar Excise Prohibition Act-2016.

16 lts. of country made liquor is said to have been recovered from the rented house of Puja Devi and petitioners are said to have been running the business of said liquor. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. They have no concern either with the seized liquor or with the said house or with any business of

Patna High Court Cr.Misc. No.12815 of 2018(2) dt.07-03-2018 2/2 liquor. They have no criminal antecedent. The petitioner no. 1 (Suraj Sahni @ Suraj Kumar) has been languishing in custody since 21.09.2017 and the petitioner no. 2 (Mantu Sahni) has been languishing in custody since 09.11.2017. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Udakishunganj, District-Madhepura in connection with Bihariganj P.S. Case no. 238 of 2017.
