JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned counsel for the Vigilance Department. The petitioner is accused in connection with Spl. Case No. 09 of 2016 arising out of Vigilance P.S. Case No. 19 of 2016 registered under Sections 7 and 13(2) read with 13(i)(d) of the Prevention of Corruption Act, 1988.

The accusation is that petitioner being the Halka Karamchari in revenue department was apprehended at the time of taking the bribe of Rs.5,000/- to the complainant, Nawal Kishore Singh on 22.02.2016.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.20849 of 2016 (2) dt.19-05-2016 suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 22.02.2016. Moreover, after investigation, the charge sheet has already been submitted against the petitioner.

Learned counsel for the State Vigilance has vehemently opposed the prayer for bail of the petitioner. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, Vigilance, North Bihar at Muzaffarpur, in connection with Spl. Case No. 09 of 2016 arising out of Vigilance P.S. Case No. 19 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
