JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Deoriya P.S. Case No. 97 of 2015, registered under Sections 25(1-b)a, 26, 35 of the Arms Act, Section 16/17/18/20/22/23 of the U.A.P. Act and Section 3/4/5 of the Explosive Substance Act. The accusation is that three accused persons, including the petitioner, were apprehended by the Police in suspicious condition, who disclosed the name of six other associates. On search, the petitioner was found in possession of one country made loaded pistol along with two live cartridges. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent is in custody since

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Deoriya P.S. Case No.97 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
