====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-07-2021 Heard Mr. Kuldeep Kumar, the learned Advocate for the petitioner and Mr. Tapeshwar Sharma, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with P. R. Case No.06 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In view of the recovery from the fodder house of the petitioner, I am not inclined to grant anticipatory bail to him, notwithstanding the fact that the fodder house belongs to the joint family and for this case, the father of the petitioner has also been made co-accused.

The prayer for anticipatory bail of the petitioner is

Patna High Court CR. MISC. No.2896 of 2021(2) dt.29-07-2021 2/2 rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall consider the case taking into account the fact that he has no criminal antecedent and the order shall be passed without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
