23-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of regular bail, arises out of Khaira P.S. Case No.40 of 2016, disclosing offences under Sections 401 and 420 of the Indian Penal Code and under Sections 25(1-b)A, 26(ii) and Section 35 of the Arms Act.

Referring to the First Information Report, learned counsel, appearing on behalf of the petitioner, has submitted that from his possession, only a cell phone of

Patna High Court Cr.Misc. No.22960 of 2016 (2) dt.23-05-2016 2/2 Samsung make was recovered. He has submitted that no offence, under the provisions of Arms Act, is made out against the petitioner. The petitioner is in custody since 02.03.2016.

Considering the submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No.40 of 2016.

This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
