The petitioner seeks bail in connection with Hajipur Town P.S. case no. 1126/2014 registered for the offences punishable under Sections 394, 395 and 412 of the Indian Penal Code.
The petitioner is not named in the first information report. It is submitted that the name of the petitioner came in this case in the light of confessional statements of co-accused namely Shiv Shanker Kumar and Vishal Kumar, nothing has been recovered from the possession of the petitioner, the petitioner is an accused in one case whereas he is on bail, besides the confessional statement there is no other legal material
Patna High Court Cr.Misc. No.21664 of 2016 (3) dt.15-07-2016 2/2 against him, he is in custody since 09.02.2016, similarly situated co-accused namely Jyoti Kumar, Rajeev Kumar and further Vishal Kumar from whose house, amount of Rs. 2 lacs was recovered have already been allowed bail and as such, the petitioner also deserves sympathetic consideration.
The learned A.P.P. fairly submits that other co-accused have been allowed bail.
In the facts and circumstances state above, petitioner abovenamed is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. case no. 1126/2014, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from the privilege of bail.
