The petitioners seek bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant stated that her family was cultivating the entire lands measuring five bighas of Mahendra Yadav. They planted paddy crops, but the accused persons were harvesting the paddy crops. When Raj Kishore Yadav went the accused persons made indiscriminate firing. The informant also stated that her family members went there and there was exchange of firing between the two sides.

It is submitted that two persons were killed from the side of the petitioners for which Lakhisarai P.S. Case No. 36 of

Patna High Court Cr.Misc. No.28930 of 2015 (2) dt.10-08-2015 2/2 2007 is registered. There is omnibus and general allegation of firing against the petitioners. Similarly situated co-accused namely Gangadhar Yadav, Sanjay Yadav and Shivdhari Yadav and others have already been enlarged on bail. The petitioners are in jail since 13.05.2015.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S.
