The petitioner apprehends his arrest in connection with Sasaram (Town) P.S. Case No.1112 of 2018 registered under Sections 324 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that in the evening of 15.08.2018, the informant along with his younger brother Divraj Quareshi was moving. At that time, a persons came there and started to scuffle with the informant. Thereafter, 8-10 unknown persons also came there and started to scuffle with the informant. At that time, Ekram Quareshi and Itherab Quareshi, the father and brother of the informant respectively, reached there to save the informant. The informant identified three persons including the petitioner indulged

Patna High Court CR. MISC. No.50060 of 2019(2) dt.09-08-2019 2/2 in scuffle. In course of occurrence, Chandan Mahto made firing from his pistol twice on the informant, which hit on his shoulder. Learned counsel for the petitioner submits that, in fact, due to some dispute, the occurrence of "Maar-Peet" took place between the parties in which both sides made firing and sustained injury, regarding which Sasaram (Town) P.S. Case No.1113 of 2018 was also instituted on the basis of the fardbeyan of one Anil Choudhary against the informant and othes. While the petitioner is named in the F.I.R. but no specific overt act is attributed to him. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sasaram at Rohtas, in connection with Sasaram (Town) P.S. Case No.1112 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
