Learned counsel for the petitioner is expected to honur his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 333, 353, 427 of the Indian Penal code. At the very outset, it has been submitted by learned counsel for the informant that the other co-accused persons on similar allegation has been granted anticipatory bail by Coordinate Bench of this Court vide order dated 02.06.2021
Patna High Court CR. MISC. No.3270 of 2021(2) dt.03-11-2021 2/2 passed in Cr. Misc. No.39531 of 2020.
This Court does not see no reason as to why the similar benefit should not be given to the present petitioner. Considering these facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Gaya, in connection with Atri P.S. Case No.238 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 2 hereinabove, failing which the matter shall be brought to the notice of this Court.
