Petitioner, already in custody, seeks bail in connection with Sultanganj P.S. Case No.17 of 2017, registered under Sections 452, 354(B), 323 and 341 of the Indian Penal Code as well as under Section 12 of POCSO Act.

Learned counsel for the petitioner submits that both sides are agnates and it is said that the petitioner entered into the room of the prosecutrix and caught her hand and assaulted but in her statement recorded under Section 164 Cr.P.C. she only says that petitioner only entered inside the room and did nothing and the case is lodged after three days of delay without any cogent reason.

Having considered the said facts and circumstances,
