The petitioner seeks anticipatory bail in connection with Kochadhaman P.S. Case No. 178 of 2018 for the offence alleged under Section 414/34 of the Indian Penal Code. There is allegation of recovery of a stolen motorcycle from the garage of one Akmal Yazdani. The petitioner's name has surfaced on the basis of disclosure made by father of the said Akmal Yazdani to the effect that it was the petitioner who had brought the stolen motorcycle.

Learned counsel for the petitioner has submitted that there is no criminal antecedent against him and except the statement of the father of said Akmal Yazhani, there is no material against him.

Learned Additional Public Prosecutor for the State

Patna High Court CR. MISC. No.45077 of 2019(2) dt.22-07-2019 2/2 opposes the prayer for anticipatory bail.

Considering the above submissions and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Kochadhaman P.S. Case No. 178 of 2018 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
