ANJANA MISHRA ORAL ORDER 03-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State assisted by learned counsel for the opposite party no.2.

Petitioners being father-in-law and elder brothers-inlaw, of the victim apprehend their arrest in Runni Saidpur P.S. Case No.62 of 2015 for the offences under Sections 498A, 323, 379, 364 of I.P.C. and 3⁄4 of Dowry Prohibition Act. Learned counsel for the petitioners submits that husband of the victim lady has already been granted anticipatory by Annexure-5 in Cr.Misc. No.15187 of 2016 vide order dated 06.04.2016. He further submits that O.P.no.2 has appeared in this

No.20613 of 2016 (3) dt.03-08-2016 2/2 Court and also in the case in which the bail was earlier granted and submitted that the marriage took place between the parties, i.e., the victim girl and the husband, namely, Md. Sunna @ Md. Munna, had already been dissolved and iddat amount has already been paid. Therefore, he does not oppose the present application for anticipatory bail filed by the father-in-law and elder brothersin-law of the victim lady. Considering the aforementioned facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today. be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi, in Runni Saidpur P.S. Case No.62 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
