The petitioner seeks bail in a case instituted for the offences under Sections-384 & 166 of the IPC and Section-50 of the Bihar Prohibition and Excise Act, 2016.

Petitioner is said to be a Sub Inspector in Police Department. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19-01-2017 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no substantive evidence to suggest petitioner's involvement in the present case. The petitioner has been falsely implicated in this case due to political vengeance

Patna High Court Cr.Misc. No.12208 of 2018 (2) dt.19-03-2018 with the informant, Bhajendra Prasad Yadav.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III-cum-Special Judge, Purnea in connection with Special Case No. 1190 of 2017 arising out of Jankinagar P.S. Case No. 100 of 2017.
