Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. Name of the petitioner has surfaced in the confessional statement of co-accused, namely, Suman Yadav. Submission is that the petitioner is in custody since 10.01.2018. Nothing has been recovered from possession of the petitioner nor the petitioner was ever put on TI Parade. Petitioner has got criminal antecedent of identical and other serious nature, though the petitioner claims to be on bail in those cases.

Considering the entire facts, let the petitioner,

Patna High Court Cr.Misc. No.9893 of 2018 (3) dt.11-04-2018 2/2 above named, be released on bail after completion of six months of custody from today if the trial is not concluded in the meantime on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Falka (Pothiya) Police Station Case No. 397 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
