JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-03-2021 Heard Mr. Vinay Kumar Mishra, learned Counsel for the petitioners and Mrs. Renu Kumari, learned Additional Public Prosecutor for the State, through Video Conferencing. This application, for grant of regular bail, arises out of Singhia Police Station Case No. 25 of 2020, disclosing offences under Sections 307, 323, 324, 325, 341, 379, 447, 504 and 34 of the Indian Penal Code.

The allegation, as per the First Information Report is that the petitioners assaulted the son of the informant on his head by means of Farsa and Gadasa.

Learned counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged and they have falsely been implicated in this case. Learned counsel further submits that both the parties are co-sharer and there was

Patna High Court CR. MISC. No.2675 of 2021(2) dt.17-03-2021 2/2 scuffle between them on the trivial issue of quarrel between the children. Learned counsel further submits that petitioners are in custody since 16.06.2020 and the parties have arrived at compromise in the matter.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that both the parties are co-sharers and petitioners are in custody since 16.06.2020, i.e., about nine months, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioner No.1, Sanjeet Singh and petitioner No.2, Sunil Singh, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Rosera, Samastipur, in connection with Singhia Police Station Case No. 25 of 2020.

It is made clear at the time of furnishing bail bond, all the parties shall follow the guidelines regarding social distancing. (Anil Kumar Sinha, J) sanjeev/- U T
