Initially, case was registered under section 307 and other minor sections of the Indian Penal Code but in course of investigation, father of the informant died and accordingly, section 302 of the Indian Penal Code was also added.
It was specific case of the prosecution that it was coaccused Janardan Pandit who gave fatal blow to the deceased and so far as petitioners are concerned, it is only stated that they had also participated in the alleged occurrence. The present occurrence appears to have taken place on account of petty dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like
