The petitioner seeks pre-arrest bail in connection with Hajipur (Town) P.S. Case No.792 of 2016 registered under Sections 341, 323, 504, 506, 452, 380, 307 and 308/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that similarly circumstanced co-accused, namely, Parmanand Pandit and Gopal Pandit have already been granted pre-arrest bail by a co-ordinate Bench of this Court vide order dated 01.07.2017 passed in Cr. Misc. No.20740 of 2017, as contained in Annexure-2 to the present application.
Learned counsel for the State opposed the prayer for
Patna High Court Cr.Misc. No.1391 of 2018 (2) dt.19-01-2018 2/2 grant of pre-arrest bail to the petitioner. However, she admitted that two other co-accused persons having similar allegation to that of the petitioner have already been grant pre-arrest bail. Considering the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishli at Hajipur in connection with Hajipur (Town) P.S. Case No. 792 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
