2. The petitioner seeks bail in connection with Nokha P.S. Case No. 55 of 2024 instituted for the offences punishable under Section 392 of the Indian Penal Code.

3. As per allegation in the FIR, it is a case of snatching, mobile, gold items as also a cash of Rs. 2,000/- looted from the purse of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner has not named in the FIR and his name transpires in this case

Patna High Court CR. MISC. No.47897 of 2025(2) dt.08-08-2025 2/3 only on the basis of confessional statement of co-accused Bittu Paswan. He further submits that nothing has been recovered from the conscious possession of the petitioner. He next submits that there is no Test Identification Parade till date. Petition is in custody since 19.06.2024.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned District and Additional Sessions Judge-IV, Sasaram, Rohtas dated 21.06.2025, it appears that on the basis of fardbeyan of the informant Sanjay Choudhary, FIR has been lodged under Section 392 of the Indian Penal Code against four unknown persons. During investigation, one co-accused, namely. Bittu Paswan confessed his guilt before the police and disclosed the name of the present petitioner and there is no any recovery from the conscious possession of the petitioner and he is in custody since 19.06.2024, so considering all these aspects of the matter and submission of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
