16-06-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Buxar Industrial Area P.S. Case No. 05 of 2018, registered for the offence under Sections 414, 120(B) of the Indian Penal Code and Sections 25(1-b)(a), 26, 35 of the Arms Act.

As per the prosecution case, huge arms and ammunition were recovered from the house of the petitioner. It is submitted on behalf of petitioner that these arms and ammunition were licensed and no illegal arms have been recovered from the house of the petitioner. Petitioner is in custody since 17.03.2018 i.e. more than three years. On last occasion i.e. on 16.03.2021, a report was called for regarding stage of the trial, which has been received

Patna High Court CR. MISC. No.4139 of 2021(3) dt.16-06-2021 2/2 and kept at flag 'A'. From perusal of report dated 20.03.2021 of learned J.M. 1st Class, Buxar, it appears that charge has already been framed and case is fixed for evidence. Petitioner is accused in 24 (twenty four) more criminal cases, as stated in paragraph - 3 of the petition.

Considering the nature of allegation, criminal antecedent of petitioner and stage of the trial, the bail petition of petitioner is rejected. However, the learned trial court is directed to conclude the trial expeditiously.
