2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Raghunathpur P.S. Case No. 88 of 2024.

3. As per prosecution case, some unknown miscreants have stolen the motorcycle of the informant.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR rather the same has been lodged against unknown person. The name of the petitioner has come into light on the basis of confessional

Patna High Court CR. MISC. No.51118 of 2024(3) dt.23-09-2024 2/2 statement of co-accused Pawan Dubey @ Vimlesh Kumar Dubey, which has no evidentiary value in the eyes of law. No incriminating/stolen article has been recovered from the conscious possession of the petitioner and he is in custody since 22.05.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Siwan in connection with Raghunathpur P.S. Case No. 88 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
