JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 25.11.2014 in a case registered under Sections 448, 354B, 323, 504/34 of the Indian Penal Code.

Almost all the sections are bailable except section 354B of the Indian Penal Code.

The contention on behalf of the petitioner is that the victim was in love with co-accused Krishna Kumar @ Mithu and as a matter of fact the petitioner and Krishna Kumar @ Mithu had gone to the house of the victim but unfortunately, the petitioner was caught by the villagers.

No.28064 of 2015 (2) dt.06-08-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Kalyanpur P.S.Case No. 387 of 2014.
