The petitioner is languishing in custody since 24.9.2015 in connection with Sahar P.S. Case No. 107 of 2015 for the offences instituted under Section 414 of the Indian Penal Code. The Prosecution story, in brief, is that the Informant who was the Officer-in-charge of Sahar Police Station arrested the petitioner and seized his motorcycle on the information that some Criminals were trying to commit crime.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.9.2015 and the charge sheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. The petitioner

Patna High Court Cr.Misc. No.20753 of 2016 (3) dt.20-07-2016 2/2 denies the recovery of stolen motorcycle. No compliance of Section 100 Cr. P.C. has been followed in the present case. On behalf of the State, it has been submitted, that the petitioner is named in the First Information Repot. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, X, Bhojpur at Ara, in connection with Sahar P.S. Case No. 107 of 2015.
