JUSTICE ARUN KUMAR ORAL ORDER 19-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Laheri PS Case No. 486 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that one country made pistol made in USA and one stolen motorcycle were recovered from the possession of the petitioner.

Submission is that nothing was recovered from the possession of the petitioner, he had purchased the motorcycle from one Alok Kumar but the vehicle is not registered at present in his name, petitioner has been falsely implicated as he refused to drive the vehicle of the police.

Whereas learned Counsel for the State submits that there is recovery from the possession of the petitioner and he has one criminal antecedent also of Excise Act.

Having considered the said facts and circumstances, the petitioner, namely, Amit Kumar @ Nimmi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Laheri PS Case No. 486 of 2017.
