2. In this case, the petitioner is seeking regular bail in connection with Sarairanjan P.S. Case No. 320 of 2022, registered for the offences punishable under Section 272, 273, 34 of the IPC read with 30(a), 32, 41 of Bihar Prohibition and Excise Amendment Act.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence and apprehended the accused persons namely Haduman Ram (driver), Kundan Kumar Jha @ Chotu and Vinod Sahni, who were sitting inside the truck. On search, 18 liters of illicit liquor was recovered from the cabin of alleged truck.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. His name has figured merely on the basis of confessional statement of co-accused Vinod Sahni. Nothing has been recovered from his conscious possession and he is under custody since 20.6.2024.

Considering the above-mentioned facts and circumstances, petitioner is directed to furnish his bail bonds after three months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Subordinate Court, learned Special Judge Excise-II, Samastipur in connection with Sarairanjan P.S. Case No. 320 of 2022, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
