After some arguments, learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to persuade the authorities that the qualification of Shastri will not stand in the way of his performance of duty on the promotional post and, therefore, the qualification of Shastri should be taken to be equivalent for the promotional post of which the petitioner is an aspirant.

This application is, accordingly, permitted to be withdrawn with the aforementioned liberty but, it is made clear that this Court has not expressed any opinion on the merit of this case. (Mihir Kumar Jha, J) Rishi/- U
