The petitioner is accused in connection with Gaya Rail P.S. Case No. 374 of 2017, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of three bags containing 220 bottles, each containing 200 ML country made liquor beneath the seat of the general compartment of HatiyaPatna Express standing at Platform No.8 at Gaya and the petitioner was found there.
Learned counsel for the petitioner submits that, in fact, petitioner being the bona fide passenger was travelling in the train, but he has falsely been implicated in this case on
Patna High Court Cr.Misc. No.7678 of 2018(2) dt.08-02-2018 2/2 mere suspicion. The petitioner has no criminal antecedent and he is in custody since 17.12.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Gaya Rail P.S.
