JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sultanganj P.S. Case No. 09 of 2016, registered under Section 25(1-B)a, 26/35 of the Arms Act.

The accusation is that on seeing the Police force some miscreants started to flee away, out of them one miscreant apprehended, who disclosed his name as Changuri Yadav. On search, two live cartridges were recovered from his possession. The apprehended person disclosed the name of the petitioners, who succeeded to flee away. He also stated about involvement of the petitioners in other cases of dacoity.

Learned counsel for the petitioners submits that, in

Patna High Court Cr.Misc. No.19776 of 2016 (2) dt.12-05-2016 2/2 fact, petitioner no. 1 is accused in Sultanganj P.S. Case No. 153 of 2015 and petitioner no.2 is accused in Sultanganj P.S. Case No. 60 of 2015 due to that reason, the Police implicated the petitioners in the present case and both the petitioners are in custody since 21.01.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Bhagalpur in connection with Sultanganj P.S. Case No. 09 of 2016 (G.R. No. 221 of 2016). Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
