In this case, the petitioner is seeking anticipatory bail in connection with Rajauli P.S. Case No. 279 of 2018 registered for offence punishable under section 414 of the Indian Penal Code.
It has been alleged that two motor cycles have been recovered from the house of the petitioner and the court below has recorded different paragraphs of the case diary. The learned counsel for the petitioner has placed reliance on the order dated 14.05.2019 passed in Cr. Misc. No.31862 of 2019 is quite different to the present case, as in that case, the motor cycle was not recovered from the house. Looking to the facts and circumstances of the case,
Patna High Court CR. MISC. No.46142 of 2019(2) dt.26-07-2019 2/2 this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law, preferably on the same day.
