The petitioner is accused in connection with Maharjganj P.S. Case No. 309 of 2015, registered under Section 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that, in fact, petitioner is not named in the F.I.R. Further submission is that F.I.R. named accused Prithivinath Singh is own brother of the petitioner due to that reason, in course of investigation, the wife of the deceased raised suspicion in respect of having hand of this petitioner in the murder of her husband, except the suspicion, there is no tangible material against petitioner to show his involvement in the present case. Further submission is that petitioner is accused in 17 other cases, but he has been acquitted
Patna High Court Cr.Misc. No.19785 of 2016 (2) dt.12-05-2016 2/2 in 15 cases and in two cases he is on bail. The petitioner is in custody since 22.03.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Siwan in connection with Maharajganj P.S. Case No. 309 of 2015.
