JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned APP for the State.
On the point of fire-arm, the miscreants snatched away Rs.25,000/- and a mobile set from the possession of Sheoji Mandal who happens to be driver of a pickup van and on account thereof, he informed the owner of the vehicle. After arrival of owner of the vehicle, he informed the local police and then thereafter, they all chased the miscreants and during course thereof, two persons, namely, Kunj Bihari Yadav, (petitioner) and Rakesh Singh were apprehended near Devkuli Dham, Kanya Uchhya Vidyalaya, Andhari Pokhar while one Amarjeet succeeded in his escape. Villagers searched each of them and so far petitioner is concerned, one live cartridge along with mobile were recovered from his possession while from the possession of
Patna High Court Cr.Misc. No.16196 of 2015 (2) dt.23-06-2015 Rakesh Singh, one country made pistol was recovered. The aforesaid recovered articles were produced before police by the villagers and on account thereof, two cases were lodged, one at the behest of Sheoji Mandal and the other, the present one, on the self statement of S.I.
Seizure by the public happens to be bailable one in terms of Section 37 of the Arms Act and on account thereof, petitioner, Kunj Bihari Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of SDJM, Biraul at Benipur, Darbhanga in Biraul PS Case No. 357/2014.
