Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 364A of the Indian Penal Code.

It appears that similarly situated co-accused Aju Kumar @ Suraj Kumar has been allowed bail by a Coordinate Bench of this Court vide order dated 18.04.2016 passed in Cr. Misc. No. 10459 of 2016. The petitioner is neither named in the FIR nor any substantial material is there against the petitioner in the case diary, except the confessional statement of co-accused, namely, Ravi Shankar.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees

Patna High Court Cr.Misc. No.8244 of 2018 (3) dt.21-03-2018 2/2 Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 596 of 2017/110/17 arising out of Kashichak Police Station Case No. 73 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
