The petitioner seeks bail in Majhaulia P.S. Case No. 762 of 2020, registered for the offence under Section 366(A)/34 of the Indian Penal Code and Section 12 of the POCSO Act. As per the F.I.R., one Tinku Kumar alongwith other F.I.R. named accused persons kidnapped the minor daughter of the informant and this petitioner is alleged to be one of the conspirator.

It is submitted on behalf of petitioner that thrust of the accusation is against co-accused Tinku Kumar. The victim girl was recovered after two days of the alleged occurrence. Petitioner has got clean antecedent and he is in custody since 11.07.2021. Investigation is complete.

Patna High Court CR. MISC. No.58696 of 2021(2) dt.04-02-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VI, West Champaran, Bettiah / concerned court in connection with Majhoulia P.S. Case No. 762 of 2020.
