Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Special Case No.78/17 arising out of Jalalgarh P.S.Case No.77 of 2017 registered under Sections 376, 313, 511 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the present case has been lodged after seven months. He further submits that victim girl is major. He submits that both the parties have already compromised the present case which is evident from the aforesaid supplementary affidavit.

No.56768 of 2017 (2) dt.06-12-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge -cum- Special Judge,(POCSO), Purnia, in Special Case No.78/17 arising out of Jalalgarh P.S.Case No.77 of 2017 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
