1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 and 34 of the I.P.C. and Section 30(a) of the Excise Act.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of three cases and allegation is of recovery of 5220.36 litres of liquor from a truck.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot, as such, nothing was recovered from his conscious possession and is not the owner of the truck and he came to be implicated based on secret information, which is the easiest way to implicate someone and

Patna High Court CR. MISC. No.51632 of 2024(2) dt.06-09-2024 2/2 at times police takes aid of secret information in order to save the real culprits and implicates those who have antecedent under the Excise Act. It is next submitted that petitioner is in custody since 20.06.2024.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Samastipur in connection with Tajpur (Halai O.P.) P. S. Case No.559 of 2022.

7. The application stands allowed.
