JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bakhtiyarpur P.S. Case No. 259 of 2015, registered under Section 399 and 402 of the Indian Penal Code and Section 25(1B)A/26/35 of the Arms Act. The accusation is that in course of patrolling duty, one safari vehicle was seen by the Police. When Police reached near vehicle while one lady and three male were apprehended by the Police, but some succeeded to flee away. The caught hold persons disclosed their names and also the name, who succeeded in fleeing away.

Learned counsel appearing on behalf of the petitioner submits that name of the petitioner has been surfaced

Patna High Court Cr.Misc. No.20806 of 2016 (2) dt.19-05-2016 2/2 in the present case in the confessional statement of co-accused, who admitted that they were present there for committing the offence of dacoity. Thereafter, the petitioner was apprehended and remanded in the present case on 10.09.2015 to the case of Salimpur P.S. Case No. 103 of 2015. Further submission is that, in fact, the petitioner is accused in three other cases as detailed in paragraph no. 3 due to that reason, Police got implicated the petitioner in the present case. The petitioner is in custody since 09.09.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-II, Barh, District-Patna in connection with Bakhtiyarpur P.S. Case No.259 of 2015 (S.T. No. 116 of 2016). Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
