Petitioner, already in custody, seeks bail in connection with Forbesganj P.S. Case No.773 of 2017, registered under Section 394 of the Indian Penal Code.

Allegation in brief is that in the night the shop of the informant was looted by two miscreants on the point of pistol, one miscreant took away Rs.90,000/- and another miscreant Rs.51,000/- but one of the miscreants was apprehended by the nephew of the informant just outside the shop and Rs.51,000/- approximately was recovered and in that process while nephew of the informant was trying to caught the miscreants, he was assaulted by the petitioner.

Learned counsel for the petitioner submits that there is no

No.7737 of 2018(2) dt.08-02-2018 2/2 recovery from the conscious possession of the petitioner and he has been in custody since 10.10.2017 whereas learned counsel for the State submits that the petitioner was apprehended at the spot and looted money was also recovered from his possession and petitioner has got criminal antecedents of serious nature. Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Forbesganj P.S. Case No.773 of 2017, pending in the court of learned CJM, Araria.
