JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Bettiah Town P.S. Case No.175 of 2014 registered under sections 25(1B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 13.10.2014 passed in Cr. Misc. No.33494 of 2014 with a direction to the court below to expedite the trial and conclude the same preferably within seven months from the date of receipt/production of a copy of the order failing which liberty was granted to the petitioner to renew his prayer for bail. It has been contended that till date no witness has been

Patna High Court Cr.Misc. No.28029 of 2015 (2) dt.09-07-2015 2/2 examined on behalf of the prosecution during trial. It has further been contended that a co-accused Antim Kumar Srivastava, whose case is identically situated to that of the petitioner, has already been granted bail by this Court vide order dated 13.2.2015 passed in Cr. Misc. No.5557 of 2015.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Rai, Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Trial No.3888 of 2015 arising out of Bettiah Town P.S. Case No.175 of 2014.
